Man Found Guilty Of Racially Abusing Le Vacherin Owner


Court hears details of the incident at a restaurant in Sutton

A man has been found guilty of racially abusing well-known Chiswick restaurateur Malcolm John last year during a row at his restaurant in Sutton.

Kevin Boxall, 42, used racist language during a visit to Mr. John's restaurant at Sutton High Street on 30 June of last year.

Mr. Boxall, who is described as a landlord of ten properties, denied the allegations, but was found guilty of racially aggravated intentional harassment, alarm or distress, at Croydon Magistrate's court.

Mr. John told the court he was standing in for the Brasserie Vacherin head chef when Mr. Boxall came in at around 1 pm with an "aggressive demeanour". He said Mr. Boxall had used derogatory language about his skin colour and he asked him to leave.

According to a report in the Croydon Advertiser, counsel for the defendant denied that Mr. John had "gently ushered" Mr. Boxall outside and said he had restrained him with the help of a customer.

Boxall denied that he was drunk but admitted to having had four single shots of a spirit and coke in a nearby pub before going to the restaurant. The defendant was found guilty. Boxall, of Wales Avenue, Carshalton, was fined £930 and was ordered to pay a victim surcharge of £93 and costs of £620.

Malcolm John opened Le Vacherin in Chiswick in 2004 and later opened Brasserie Vacherin in Croydon, followed by the Brasserie in Sutton.
