Judicial Review of Chiswick Cycleway Postponed


Case will be now heard in the Autumn after appeal on another case is heard

The Judicial Review into the temporary segregated cycleway in Chiswick has been postponed until the Autumn according to an announcement by the OneChiswick group. It was originally due to take place on 17/18 June.

It says, “This decision was agreed mutually between all the parties; One Chiswick Ltd, London Borough of Hounslow and Transport for London and has been confirmed by the Judge, Mr Justice Kerr.”

It is understood that the delay is to allow the appeal being made by Transport for London (TfL) against a judgement made by Justice Lang on its Streetspace scheme in Bishopgate to be decided first. In her original ruling, Justice Lang determined that TfL had paid insufficient attention to access for the disabled by imposing restrictions on Black Cabs. The case which was brought by the taxi drivers’ unions, UTAG and the LTDA, could have implications for the hearing on the Chiswick cycleway.

The latest information we have is that the appeal is due to be heard in the Autumn and the delay in the Judicial Review sought by OneChiswick will allow both parties time to review the extensive evidence already submitted in the case in the light of the appeal decision.

OneChiswick has raised over 90% of its £40,000 target to fund the Judicial Review but now says on its web site that costs may total £50,000.

The group plans further legal challenges to Streetspace measures implemented in the Grove Park area if it can raise sufficient funds.

The campaign group describe the two-way cycle route as ‘dangerous, unworkable and unwanted’ claiming that it contravenes equalities legislation particularly with regard to disabilities. Hounslow Council says that by providing safe infrastructure for active travel they can reduce car use in the area and help avoid a ‘car-lead recovery’.
